Non-Molestation Order

  • Molestation Includes

    • Physical violence

    • Threats of violence

    • Harassment and pestering

    • Psychological, sexual, financial, and emotional control

    • Inciting or instructing a third party to carry out actions 

    • A Non-Molestation Order prohibits contact from the respondent for a period of time — typically between 6 and 12 months

    • They can be made

      • Ex-parte – can be made without offender being aware (in emergency situation)

      • Inter-parte – offender will be given notice of a court date

  • Breach of a Technical Nature

    • Starting point: fine & compensation order

    • Sentencing range: fine to community order & compensation order

    Breach of a Fundamental Nature

    • Starting Point: 3 month custody & compensation order

    • Sentencing Range: community order to 6 months custody & compensation order
